Need GST calculation and other tax builder may levid
We had bought Villa in 2015 , pre launch but builder did not have build a single brick on our plot till now . Now he asking GST extra .
He has mentioned in agreement
32lakh construction cost and
28 lakh land cost .
3 lakh development charges
Extra charges for club house subscription
Extra charges to get Electricity , water n other telephone line facility
Now recently he Registered plot to our name for 7.2 lakh , I don't understand what on rest amount bank has released to him ... Hdfc bank is involved in this has no demand draft given to any customer by builder but directly submitted to bank. He not ready to give segregation. Asking him gstin no . We asking him to transfer input credit. Will on every payment GST to be paid or only on construction cost and not on development cost ?

Your question is not very clear. There seems to be lot of loopholes in the way the builder is dealing. You can file a claim against the builder as being the buyer, you have full right to know the break up and also the registered value cannot be so low as compared to the purchase price.
My suggestion is pay GST on the full amount as of now since the builder is refusing to give details.
GST shall be payable at the rate of 12% on entire purchase consideration.

Bank confirmed OC is submitted by builder so RERA is not applicable . I need copy of the builder documents from HDFC legally. I need that OC certificate . Why to pay GST when he got OC certificate . On project only on Approval of layout who gave him OC I want to check. Bank refused to give me copy of OC . How to get it .

Isn't this problem being faced with other people as well? Why don't you get together and demand full transparency from the builder else file a complaint against him. You have paid your hard earned money to him and you have full right to know the full details of things that impact you.
If the construction was completed before GST implementation, the builder cannot levy GST.
Ask the builder to share the OC.
