Whether flats received by land owner in consideration of land given for development to the Builder is liable for payment of vat by the land owner?

Madam, this question belongs to the year 2014-15, when there was a a vat regime. The A.O.is doing assessment of the builder and wants the land owner to pay vat on his consideration received from the builder.

VAT and service tax were applicable on land owner's share too. The builder was supposed to collect it from you and pay it. However, the liability may also differ by the mutual agreement between you and the builder. Please check the agreement for such clause, if any.
