• Name change of company and information to service tax and RBI AND SEBI

Dear sir,
 if a company changes its name -is it necesaary to inform servicetax department,rbi and sebi and nse.and after name change is it necesaary to use former -like if earlier name was abc pvt ltd and now new name is xyz ltd .so is it necessary for me to use xyzltd(former abc pvt ltd). do i change and modify all records ?book of accounts of my customers .if i am changing 
anything in inovide is it necessary to inform service tax department.if i am using software to raise invoices?do i need to take permission from servicetax department.
mujhe kis kis department ko batana padega.kya mujhe naya pan no and service tax no bhi lena padega.PLEASE REPLY WITH SUPPORTING ACTS.

Dear Sir,

Apply for change in Name with ROC, Income tax (i.e. PAN), Bank account, GST. Yes you need to apply for new PAN and GST. Surrender the old PAN and GST.

Please find below the list:

1. Intimate RBI (if company has foreign funding/loan) SEBI (if company is listed), NSE (if company is listed), BSE (if company is listed)

2. Update the MOA & AOA

3. Update Letterhead, invoice and any other stationary of the Company

4. Apply to update IEC (if company is in import & export), PAN, TAN, Shops & Establishments Registration, Professional Tax Registrations, Maharashtra Labour Welfare Fund Registration, GST, any other labour law registration as may be applicable on the Company.

It is not mandatory to use old company name on the documents as "earstwhile known as xyz Limited", however, it is suggested to use on the company papers at least for an year.

MOA and AOA will have the footnote to disclose the earlier name.

5. Update with Service tax department.

Yes, it's necessary to inform service tax department. Information to RBI is needed only if company has foreign funding. If company is listed, then information to sebi, nse and bse is also required.

Apart from it, you will have to et the name corrected in your existing PAN, TAN and GSTN.

From companies act perspective, you will have to amend MOA, AOA and other documents like letterhead.

Is better to use old companies name as well.

Hi

In case of change of name of the company, all the relevant departments need to be informed.

Since you would have already updated with the ROC, the next step would be to get the name change updated in the company's PAN.

If the company was registered under service tax, it needs to be updated with the service tax department .

The updation shall be with service tax Dept, excuse Dept., RBI, SEBI, NSE/BSE, PAN, TAN, etc wheresoever the company has relevance to.
