• Should my company register for GST?

1. My company is an e-commerce services marketplace and qualifies as an E-commerce Operator. My platform connects buyers and sellers of the services.
2. I also intend to sell physical products (mobile phone covers under Rs. 1000) across the country under the same company name
3. I just started the business 9th April 2018 and hence turnover is not Rs.20 lacs/annum.
4. Do I have to register for GST?
5. If yes, under what category and HSN/SAC code will I have to apply?

Hi,

It is mandatory for e-commerce operator to obtain GST registration irrespective of the value of supply made by them.

GST Registration for the person selling through e-commerce operator: For the person who undertakes supplies through e-commerce websites, it is mandatory to obtain GST registration irrespective of the value of supply made by them. The application for registration must be applied irrespective the ownership of the websites or portal through which supplies are made.

As an e-commerce operator you have to mandatorily register for GST irrespective of turnover. Refer section 24

Sec.24 provides that the following categories of persons undertaking taxable supplies shall be required to take registration irrespective of the threshold limit:-

⇒ persons who are required to pay tax u/s 9(5) (Specified Category)

⇒ persons who supply goods or services or both, other than supplies specified u/s 9(5), through such electronic commerce operator who is required to collect TCS u/s 52.

⇒ every electronic commerce operator

⇒ every person supplying online information and data base access or retrieval services from a place outside India to a person in India, other than a registered person.

yes sir you are required to take registration under GST.

For the person who undertakes supplies through e-commerce websites, it is mandatory to obtain GST registration irrespective of the value of supply made by them. The application for registration must be applied irrespective the ownership of the websites or portal through which supplies are made.

GST Return Filing for E-Commerce

GSTR – 8 return is to be filed by E-commerce operator every month within 10 days after the end of such month. Under GSTR-8 return details of outward supplies of goods and service made by sellers through the platform and amount of TCS collected is to

be reflected.

E-commerce operator is also required to file an annual statement by 31st day December following the end of the financial year in which the tax collected.

1. It was mandatory but due to amendments the benefit of threshold of 20 lacs is available to e-commerce operators also.

2. That should be fine unless the objects of the company restricts you to do so.

3. GST registration can be postponed.

4. Same as above.

5. HSN codes that you may use are: 998365, 998599, 996812 etc.

Yes, you are mandatorily required to get registered under GST since you are undertaking E-commerce operations. This is irrespective of the turmover that you may have.

Since its an e-Commerce business, you will need to get yourself registered in GST irrespective of the threshold limit. The threshold of 20 lacs is not applicable to you.

you need to register under GST. Further you cant opt for registration under composition Scheme.Further you as and when law comes into effect you will be required to collect & deposit 1% TCS of every transaction. (It has been postponed till September). You will have to register using FORM GSTREG - 07.
