• Place of business for GST application?

Hello... I am sadanand... As I applied for gst number it got rejected because of place of business... Since I am opening ecommerce store it is required for Facebook adds and PayPal... As I am living in leased house and that too lease agreement in my mother's name. So what should I provide as the place of business proof? since i dont have company

Dear Sir,

Attach latest electricity bill of owner and lease agreement copy. Lease agreement should be with you and not with your mother because your mother is not owner of the property therefore she can not give NOC/consent to use the premises for business. Also it may be mentioned in any of the clauses of the lease agreement that it can not be further sub lease for any other purposes.

You can provide your leased house as place of business.

Provide a No Objection Certificate from the lessor.

You can try providing the leased house as a place of business.

You will have to give NOC of your mother as well as landlord.

Firstly add your name in the lease agreement along with your mother, secondly get your self a udhyog aadhar through MSME website, (it's FREE)

There is a very simple remedy available to this. For cases where place of business is not owned and there's no lease agreement as well. You can take NOC from both original lease holder and property owner.

In your case as you are a freelancer, use home as your place of business and take NOC from your landlord and mother both.

Your leased house will be treated as place of business provided you have NOC.

If you don't have, need to take NOC from both lease holder and property owner.

Also submit a NOC from the lessor and feom your mother.

As a proof of place of business, you can provide your lease agreement copy along with latest electricity bill.

Also, please take a NOC from lessor and from your mother and submit the same .

You can enter into an agreement with you mother as sub-lease, attach both the agreements along with Latest electricity bill & NOC from owner.
