• Gst on flat purchase

Hi sir, i have purchased a flat which is under construction from a builder, builder had an agreement with couple of people who owned the land. Builder has marketed the sale of property and i have bought the same from one of the person who owned the land. My question is do i need to pay gst?
To whoom should i pay the gst? My registratiom completed in august 2017.but i have not paid yet. Now i am getting calls to pay gst. Please tell me if i am liable to pay. All the cheques were relrased on landowner and his mothers name.

Hi,

If you have bought the property underconstruction, GST is applicable on the Transaction.

Now the moot question here is who will pay the GST? You should check your agreement and see what is written in the agreement about the taxes.

Dear Sir,

The person who renders services of construction is liable to collect and pay GST. If landowner is asking for GST,please ask copy of tax invoice with GSTIN.

I think in your case GST will be applicable. However can you check the agreement and share what was agreed with the seller.

Hi

Yes, GST shall be applicable as the flat was under construction when purchased. The payment of GST shall depend on the agreement between the builder and the land owner.

However, if all the payments were made before July 17, no GST was applicable.

Yes GST is applicable in this transaction however Land owner from whom you bought the flat is responsible for collection and payment of GST.

Whether you should pay him GST amount separately or not is depend on agreement whether price agreed between you and seller is with GST or excluding GST.

Yes GST is applicable on under construction property. As you have mentioned that the property u were buying from is from the person who owns the land, you should pay GST to the owner of the land.
