• Capital gains tax calculation

Hi 
So i had to pay stamp duty twice for registration of my house - the house had to be registered first for my seller and then for myself on the same day. This is because i had brought tbe house via NOC - defence managed apartments 
Question - since i paid for stamp duty for my seller can i add the seller’s stamp duty as well as mine to the capital gains value computation so that my capital gains amount goes up ?? 
Also can i add the expenses for work done in my house after i purchased it - like woodwork etc ??

Yes, you can include both expenses in your cost of acquisition.

Also take the benefit of indexation.

Hi,

Yes, the expenses for work done in your house will be treated as cost of improvement.Cost of acquisition and improvement is indexed by applying CII (cost inflation index). It is done to adjust for inflation over the years.

Indexed cost of improvement = Cost of improvement *Cost inflation index of the year in which the asset is transferred Cost inflation index of the year in which improvement took place.

Also, you can deduct the stamp duty you paid when you bought the property to reduce your overall gain when you sell.

Why do you want to increase your capital gain?

Secondly stamp duty paid for purchase can be an expense under section 80C and stamp duty paid for sale can be an expense of sale but same cannot increase your capital gain.

You can add the woodwork done as cost of improvement but for that you need to have proof of such expense, only then you can claim such expense.

Hi,

You can add both the stamp duties in your purchase cost. You should have a proof for payment and any written arrangement for paying stamp duty on behalf of seller.

Yes, you can add expenses incurred for woodwork. Please not it should not be in the nature of routine repairs. It should be substantial or new woodwork.

Yes you can add the stamp duty to your cost so that your capital gains are reduced.

You can also add expenses incurred for woodwork provided you have adeauate supportings/proof for the same.

- You can add both the cost of registration in cost of a property.
