So you are choosing business code 16006 which is for advertising covered under profession and so you can't show income under section 44AD you need to show profit under section 44ADA i.e. 50% profit of gross receipts.

If you are other than company or LLP then yes you are eligible for Section 44AD

Ideally it is not covered in both the sections. However, considering the nature of services and lack of clarity from income tax department, you can consider it as information technology services which is covered under 44ada.

I think you can show your income u/s 44AD under the code of advertising since section 44AA gives a list of profession covered. Therefore I think you can show it under 44AD.

Hi,

- Usually section 44AD applies to business only and business is generally presumed to be trading/retailing/manufacturing only but the scope of definition of business includes more than trading.

- Advertisement services/agents have been held to be business under the guidance note issued by the Institute, therefore Sec.44AD is applicable to you.

Actually, your case does neither fall in section 44AD nor in 44ADA.

However, if you have not kept your books of accounts, then you can opt for section 44ADA under information technology professionals.
