• Cancellation of GST applied, still receiving notices from GST portal to file returns

HI, I have taken GST registration last year. However, after the rule that one does not requires to apply for GST if annual turnover is less than 20 lakhs, I have applied for cancellation for GST in 1st week of September to cancel it from August 1 2018. When ever I track the application, the status shows as "Pending for processing" assigned to STATE.

Yesterday I got a call from gst (state) office that I am not filing my returns and that I should. I have applied for cancellation of GST from 1st August 2018. So I was of the opinion that I need not file returns now. 

However, today i received a notice on sms that I have not filed my return for August.

What should I do now?
I am confused.

When I have applied for cancellation for GST registration, do I still need to file return?

Hi,

You do not need to worry.

It may be system generated. You dont need to file return.

As per GST provision of law, you have to file the return till your cancellation is processed. So you need to file the return

Yes, you will have to file return as your cancellation application is still in progress i.e. your GST registration number is active.

Hi,

Please note that till the time you don't get cancellation certificate, you are laible to charge GST and file return.

You cant stop filing return.

I would suggest just write a letter to your jurisdiction GST officer that you have applied for cancellation of GST number and therefore not liable to file GST return. Do send 2 copies of that letter and get his sign on 1 copy as an acknowledgement of receipt of such letter so that you can keep it as proof for any future notice.

Hi

Till the time the application of cancellation is processed and you receive the confirmation for cancellation of GSTN, you are liable to file the GST returns irrespective of the fact that you have applied for cancellation.

Dear Sir,

Please file a grievence against your cancellation request deamding its status.

Submit its copy along with the cancellation request as reply to the notice received for not filing of return.

And Wait no other things need to be done at your end.

Since you filled all the returns and got confirmation for cancellation then its closed now.Nothing with regards to GST to be done now.
