• Notice issue from service tax department for FY 2013-14

Dear sir/madam 
my client doing business of transport having owned trucks and also book others truck to transport coal under tender of addani etc, a notice issued by service tax department for "non payment of service tax for the financial year 2013-14". but proprietary firm not registered with service tax because covered under GTA so pls help me regarding official reply with case law.

Just reply them that you are convered under GTA and not liable to pay service tax however tax would be paid by recepient of service under RCM method and take some payment proofs from your service recepient and also give proof of your nature of business with covering letter to them..

I don't think any case law is required as it is mentioned in law that in case of GTA service in case service provider is a proprietary concern and receiver is a company service tax shall be paid by the receiver under RCM.

I think this reply would be enough.
