My wife is registered for GST. She has two commercial tenants. One of the tenants pays 35000/ per month but wants to pay GST even though her total rents do not go over 20 Lakhs. Can she still not charge GST from the other tenant whose rent is 40,000/ but he does not want to pay GST if it can be helped?

Hi,

- GST is applicable only when value of total supply on single PAN exceeds Rs.20 lacs. In your case, value of total supply on single PAN is Rs.9 lacs which is below the threshold limit but your wife has taken GST registration so she needs to charge GST even value of supply is less than Rs.20 lacs.

If you have been registered with GST you have to charge GST by all tenants irrespective of turnover limit.

After getting registered under GST , you must have to charge and pay GST even on a single Ruppee Transaction, limit of Rs. 20 Lakhs is for Compulsory Registration.

 

you no option for pay on 1 supply and not pay on other supply.

If your wife is registered under GST then she needs to charge GST from both the tenant if her turnover from business is below 20 lakh surrender her GST number and then she need not charge GST.

Also if she charges GST from 1 tenant she need to charge it from other one also.

Ask the first tenant that she is not required to charge GST then why he wants to pay GST.

Hi,

 

Once you register for GST, you will have to charge GST to each and every tenant irrespective of turnover. You can't charge GST selectively.

Yes, you need to register for GST only if your rent along with other table supplies exceeds 20 lacs per annum.

According to the law if you are registered for GST then you have to charge GST to each and deposit the same to the govt. Irrespective of your turnover.

Up to  Rs 20 lakh, there is no liability either to register or pay GST, but if you cross the threshold of 20 lakh , you need to register for GST .

Dear Sir,

 

Yes, once you get registered under GST, you will raise GST invoice party wise.

This means, the tenants will claim GST paid by him, and collected by you.

You are liable to pay this GST to the government.

 

No Matter what the turnover/receipt is.

If the aggregate turnover exceeds 20 lakhs in a financial year, you are required to take registration under section 21 of CGST Act.

However as per section 25(3), one may opt for registration voluntarily, even if their turnover is less than 20 lakhs. But once registered they have to comply with all the relevant provisions, that are applicable to a registered person.

If the rent is below INR 20 Lacs, no need to register.

 

Further, if she gets registered then she needs to pay GST @18% on the total amount of rent received. It's better to convince the 1st tenant for not paying GST amount.

Your liability to GST arises only if your turnover exceeds Rs 20 Lakhs. However, for turnover upto Rs 20 Lakhs, the GST Registration is mandatory. Once you register, you need to pay GST.
