• Can I claim stamp duty and registration charges paid for under construction property, under 80C?

In Feb 2019, I bought an under construction residential property and did registration of agreement for the same by paying stamp duty and registration charges. I will get possession of property in Dec 2020. Can I claim Stamp duty and registration charges under section 80C while filing tax return for FY 2018-19?

If the deed has been registered in your name then you can claim such stamp duty as deduction u/s 80C because it amounts to transfer of property.

When I had opened your question actually the follow up question was not available so I missed it.

So as per section 80 you can claim principal amount of repayment in the year of repayment because it says that once can claim repayment of loan taken for purchase or construction so it doesn't says that deduction can be claimed only after possession, it is only mentioned in section 24.

- Yes you can avail the deduction of stamp duty and registration fees in the F.Y. 2018-19 i.e. A.Y. 2019-20.  It is not linked with the possession of the property.

- Yes you can also claim the deduction of principal payment made.

Deductions shall not be provided for the principal repayments before construction.

Only Deduction of interest payments shall be available under 5 equal installments starting from the year of completion.

Yes, you can claim these expenses under section 80C only in FY 2018-19.

 

This deduction can only be claimed in the year the actual payment is made towards these expenses.

If you have a home loan for an under construction property then it is possible to get tax deductions up to Rs. 2 Lakhs on the interest payments made in a year and up to 1.5 Lakhs towards any principal payments made under Section 80C of the Income Tax Act.

 

However, it is important to keep in mind that tax benefit is not available on principal repayment made during pre-construction phase.

 

The interest paid while the house is under construction, will continue to accumulate. You can claim deduction on this amount for five years after possession.

No, the principal amount paid in previous years cannot be claimed under 80C after possession of the property.

Hi

 

Yes Stamp duty and registration charges can be claimed in year of payment itself as 80C deduction.

But Principle paid before completion is not allowed as deduction.
