• Failure to report income

My son filed IT return for FY 2018-2019;it has been assessed and refund ordered. He failed to report in Income Exempt section a sum of Rs.2,69,000/- he received as maturity proceeds of LIC Life Endowment policy. A revised return cannot be filed, since assessment has been completed. Anyhow, he and I, are anxious to bring this income to the notice of IT authorities. How to do it?

You can still fill a revised return as the assessment there means assessment under 143(3) and not under 143(1). Have you tried filing a revised return?

Or else you can file a rectification request online against the assessment order you have received u/s 143(1) and you need to upload the XML file of your return. If assessment is completed under 143(3) which is not possible you can file a rectification request before ITO.

Since it's an exempt income there won't be an issue even if you skip it but it's always advisable to disclose all the income.

Hi,

 

You cannot write this thing to anyone. You can file revised return and report this income in ITR since the assessment which you are talking about must be u/s 143(1).

 

If its u/s 143(1), revised return can be filed or rectification can be done.

- Please file a revise return. Rectification is filed only when there is mistake in the intimation u/s 143(1). 

- It is a preliminary assessment u/s 143(1) which is not a final assessment.

You can file revise return.

If you file rectification you need to mention all correct details with section and everything of original return and generate XML file and upload it on e filing website.

Further, rectification u/s 154 can be filed in certain circumstances. We will have to see your online account.

Yes, you can file revised return.

 

A rectification request can be filed only for returns which are already processed in CPC, Bangalore.

If on rectifying a ‘mistake’ there is a change in Income – a rectification should not be filed. In this case, a Revised Income Tax Return should be filed. No new deductions or exemptions are allowed to be claimed.

The due date for fling the return of income for FY 2018-19 is July 2019.  Where you have filed return much before the due date, you can still file a revised return.  Also, processing oline form and issuing 143(1) and refund does not mean complete assessment is over.  You can still file revise return and assessment can be made.  SO please proceed to upload revised form.

You need to revise your return.

 

The I-T Act does not bar a taxpayer from filing a revised return revised I-T return after issue of notice under Section 143.

 

You can submit a rectification request after the income tax return is processed or on receiving an Intimation u/s 143(1). You can rectify mistakes apparent from the record. Under this section, one can rectify clerical, arithmetical mistakes, a mismatch in tax payments, inclusion of income chargeable under an incorrect heading, and even changes in your resident status.

 

Further, there must be confirmation that the mistake is apparent from the records and it is not a mistake that requires debate, elaboration, investigation, etc.

You can file a revised return for F.Y. 2018-19. Since the final assessment must not have completed. You can share the assessment order received to get a better solution.

If a revised return cannot be filed, you can use the option of rectification.

No Sir, you can not write this thing to someone in IT Department.
