Applicable GST rate for items falling under Chapter 3822
The rate of GST for products under 3822 was initially fixed @18% during the 14th council meeting held on 16th May 2017. It was subsequently revised from 18% to 12% as decided after 16th GST council meeting held on 11th June 2017. In the revised notification ‘All diagnostics kits and reagents’ have been mentioned. Our products are laboratory reagents falling under 38220090. Would like to know what would be the applicable GST rate for our products. Also how correct would be the statement if somebody says that the exemption is only for diagnostic kits and their reagents and not all reagents.

The rate mentioned for your HSN is 12%.
There is no such notification on GST website. Can you please elaborate what exemption are you talking about

The notification is not only for diagnostic kits and their reagents. It includes ‘All diagnostics kits and reagents’.
In your case, GST%12% would be applicable.

There is no clarity on this as to whether it includes all reagents or regents relating to diagnostic kits.
I would advise you to follow the practice which industry is following with respect to GST charge.
