• GST for freelancer whose customer outside of India

Hi, 

I am working as a freelancer on Upwork site. I am withdrawing payment in INR on my saving account. 

 As per my understanding, 20 lacs INR turnover, there is no GST.
Above, 20 Lacs, if i withdraw in Foreign currency, It can be exempt but i need to get FIRC document. 

what would happen if i continue withdrawing payment in INR, is there a way to exmpt or zero GST for foreign customers ?

Can someone help me for preparing document and process for FIRC document from HDFC ?

Hello Sir,

 

- I am based in Rajouri Garden, New Delhi and assist you in preparing documents to get FIRC. 

 

- It will be treated as export of services which is treated as zero rated supply. No GST  is payable till the turnover reaches Rs.20 lacs. After that you can apply for the LUT and export services without payment of taxes.It is not withdrawal of payment in INR instead receiving remittance in the form of foreign currency which results into export of services.

If turnover is above 20 lacs, you need to register for GST and apply for a Letter of undertaking. If remittances are receives in foreign currency them only it would be treated as a zero rated supply.

If you dont take LUT you will have to pay GST and then you need to prove that you do export of service and claim refund of such tax.

You need to register for GST and apply for LUT and pay zero tax on export.

Hello,

 

If you get foreign currency as your consideration, you need to obtain LUT, to supply these services taxfree.

Otherwise, you will have to GST on it and claim as refund afterwards.

GST exemption is not available if you are engaged in the export of services. You need to get registered under GST and file the returns. GST may need not be paid if LUT is applied.

Documentation for FIRC can be done basis the requirements of the Bank.
