• Deduction u/s 54F

For claiming/calculating deduction u/s 54F in formula net consideration will be actual sale price of property or deemed sale consideration u/s 50C will be the sale consideration.

Section 54F clearly provides the meaning of net consideration which says net consideration means the full value of the consideration received or accruing as a result of the transfer of the capital asset as reduced by any expenditure incurred wholly and exclusively in connection with such transfer.

 

Thus it won't take into consideration section 50C value.

As decided in many case laws, while computing the deduction for the purpose of Section 54F of the Act, we need to consider only “net consideration i.e actual sale price of property”.

Hi,

 

- Section 50C deals with the value of consideration in case of sale of immovable property. In such cases, stamp duty value is the minimum value adopted by the tax authorities. If the actual sale price is less than stamp duty value then it should be supported by facts i.e. valuation report.

 

- In your case, it seems that the actual sale price is less than stamp duty value. At the time of filing the ITR,You should claim the deduction basis on the actual sale price subject to the above views.
