• Tax fraud

1 . my husband filled my false it return individual without knowing me and big fake income declared by him in my it return 2018-19 .but I m not earning women.i m a house wife.
2 . Now he had filled divorce case against me and he denayed for maintenance on the basis of false it return which he filled last year without knowing me.he cheat me with pre planning.now what can I do?
3 . I don't memorized that I signed him any acknowledgement or not during our good relationship last year

Hi

 

Merely an IT return would not be sufficient to prove your source of income. It must have equivalent proofs of receipts in your bank account. Further, it depends on what head the income is shown in.

You may challenge the same stating the true facts of how returns were filed.

 

Signing of acknowledgement is not compulsory. E-verification could have been done.

However, he will not be able to proof anything through IT returns. He must have sufficient proofs to justify the same.

- No need to worry. Income should have a trend and must be supported by the conclusive evidence. Generally income from tailoring and tution is received in cash but still it needs to be prooved. Change your password on the income tax login to avoid further misuse. Also mention this fact in the compliant filed by you if any.

Income would be required to be proved. You can submit your arguments as the returns were filed fraudulently. Better consult a lawyer.

Even cash income should have conclusive evidence. I would advise you to consult a good lawyer. A lawyer could guide you better on this matter.

You can revise the return and show it as nil income if you are not actually earning anything and secondly this is not a CA related query and you must consult a lawyer, all I can suggest is when you file an ITR it contains the IP address of the computer from which it has been filed so you show track that with help of cyber expert and prove that it has been filed by your husband if he has filed it with his computer.

I guess the court not only considers past return but also should consider whether you will do work in future. 

You should try and explain the fact to court that this return is false. You should deny the return as yours and completely say that you have not signed it.  This was a fraudulent return file in yourname by him.
