• RD/FD in the name of mother

I and my wife both are in 30% tax bracket,on monthly salary I transfer some amount of mine and wife salary in my mother saving bank account and operate RD/FD in the name of mother and pay due tax normally 5% (as per income of my mother) on interest earned on these RD/FD.and whenever required my mother provide me these RD/FD amount for my use.my question is,is this legally sound ? or I need to some documentation etc regarding this.

Hello There,

This is okay to do legally as you are transacting with your relatives. But morally, its wrong as your sole purpose behind this is the evasion of tax. Hence, be extra careful in such transactions and do not complicate such things in future.

Yes you need documentation i.e. gift deed whenever you give some amount to your mother or when your mother gifts you some amount if it's a big amount.

It is advisable that gift the amount through banking channel and prepare a gift deed for the same.
