• Do I have I to pay professional tax

In 2019, I started a business for selling books online via flipkart and Amazon. As Amazon needs a gst number for opening a sellers account. I applied for a GST number and got a number as per the rules. But, after selling 3 books, I closed the business. As books are exempted from Gst, never filed a return (Actually, I have lack of knowledge about all tax things). On 10th January 2020, I got an email. following is email I received:

And whereas you have failed to get yourself enrolled and to pay the tax due from you,
 
You are hereby given notice to appear in person or through an authorised representative on [deleted] at 12-00 P.M. before the undersigned with accounts, registers, documents and other evidences as have been maintained by you so that determination of tax due from you for the period from 2016-2017 to 2019-2020 may be completed.
 
Please take notice that ex parte order may be passed in the event of failure to appear personally or through an authorized representative on the date and time specified hereinabove.

As per WB P.tax rule, A business under rs.5 lakh turnover does not need pay P.tax. my turnover was not even rs.500.
What should I do now?

Hi,

 

You need to get an opinion form WB professional tax expert. However, if you are correct about the exemption below 5 lacs, then definitely you can reply to the notice stating that your turnover was well below the specified threshold and hence you were not required to take any registration.


You should visit the concerned department along with this submission.

First the email id from which you have received such email id if its official or not.

I thinks its a Spam mail.

Sir the email gets deleted if you paste entire email id.

It would be better if you can share it on email or paste it in a way where it doesnt get deleted.

Professional Tax is levied by the State Governments. It would be advisable to consult a CA/Tax consultant practicing in your state area. You must comply with the notice received by either hiring someone practicing there to represent you or you can personally meet the officials and discuss.

It seems that they have got some lead from other departments such as gst department or income tax department and they have not verified the lead and sent bulk emails. Many people have received such emails in west bengal.

 

So, My advise would be to file a submission and habe a personal hearing.
