• GSTIN for startup exporters

I'm expecting few orders for export during the next 10 days for Brass Vases and Artificial Jewellery. Orders will be for individual items that can be packed individually and ship through courier or India Post. Can you please provide answers to my following queries:

(1) Right now I don't have GST number and my export turnover is also NIL. Is it necessary for me to obtain GSTIN even if I get orders of export for few lakhs? Can I start purchasing & exporting items without GST Invoice?

(2) Can I issue Invoice without GST number for export purposes through post/courier, if required?

(3) Is it necessary for me to contact Custom House Agent if I export through India Post?

Hi

 

1. For inter state supply of goods, there's no threshold limit for registration. You need to get registered within 30 days of your first outward supply. However, since your case is export of goods, you need to take GST registration beforehand.

 

2. GSTIN shall have to be quoted on the shipping bill. So you need to take GST registration before first shipment only.

 

You will also have to apply for letter of Undertaking after GST registration for exporting goods without payment of IGST.

Further you will need an Import Export Code for export of goods. 

 

You can directly export through India Post by filing the requisite form.

Yes it is as you are going to export goods and export is known as inter state supply in GST and in GST whenever you do inter state supply you need to take GST registration even if your turnover is zero.

No you should not issue without GST invoice.

No that would not be required.

You also need to have IEC code.

However there are some peculiarities when exporting through post and courier and I have some clients doing this therefore if you need any suggestions you can contact me.

My views are as follow:

1. GST Registration is mandatory in export and/or import irrespective of the turnover limit.

2. No, You can not issue an export invoice without GST number.

3. No, you can make a declaration to the Indian post.

Hello,

 

1. Yes, you would require GST Regn. before the export procedure. IEC Code would also be required.

2. No, that would be a violation of the law.

3. The Authorised Courier has to contact with the respective officer of Customs.

1.Yes, it is necessary to obtain GSTIN for export of goods without any turnover limit. 

Export of goods or services is treated as a zero-rated supply. An exporter dealing in zero-rated supplies can make exports with or without payment of tax. The exporter may supply goods or services or both after paying the amount of IGST and can claim a refund of the amount of tax paid on such goods or services or both. The exporter may supply goods or services or both under bond or Letter of Undertaking without payment of integrated tax and then claim a refund of the unutilized input tax credit.

 

2. No, you can't issue invoice without GST number for export purposes.

 

3.No, it is not necessary  to contact Custom House Agent if you export through India Post.
