• How to get certificate for 80DD and 80DDB

2 years ago My father suffered brain stroke, since then he is having multiple neurological disabilities(bed ridden with residual dysphagia, aphasia and spastic quadriparesis ) and we have hospital bills for the treatment.

I am looking for tax deductions under 80DD and 80DDB. am I eligible for the same?
1. What all documents required for 80DD and 80DDB?
2. is form 10IA sufficient for 80DD? or a separate disability certificate also required?
3. How to get disability certificate for 80DD ?(if required)
4. How to fill form 10IA ? any pre-requisites for the same? can a private hospital doctor provide form 10IA?
5. Is form 10I sufficient for 80DDB?
6. How to fill form 10I ? any pre-requisites for the same? can a private hospital doctor provide form 10I?

Dear Sir,

Hope you are doing well !!

As per the income tax laws to claim deduction, one is required to obtain a certificate in the prescribed manner as mentioned in Form 10-IA. The certificate must be obtained from the prescribed medical authority."

The medical authority who is required to issue the disability certificate shall be a neurologist having a degree of Doctor of Medicine in Neurology (in case of children, a paediatric Neurologist having an equivalent degree) or a civil surgeon or chief medical officer in a Government hospital.

Hello,

For Deduction u/s. 80DDB, Form 10I is no longer required. For Neurological Diseases where the disability level has been certified to be of 40% and above, the certificate to be taken from Neurologist having a Doctorate of Medicine (D.M.) degree in Neurology or any equivalent degree, which is recognized by the Medical Council of India.

For deduction u/s. 80DDB, to avoid the claim of deduction, a medical certificate is mandatory when one wishes to claim the deduction with respect to the mentioned disabilities from any Government Hospital. The document should certify the disability of the dependant and the person they are dependant on. The certificate needs to be renewed periodically.

I hope that this answer satisfies your requirements.

Yes multiple disabilities is covered u/s 80DDB.

Yes Form 10-IA would be sufficient in your case.

You need to get it from doctor. He can be a a Neurologist having a degree of Doctor of Medicine (MD) in Neurology (in case of children, a Paediatric Neurologist having an equivalent degree); or a Civil Surgeon or Chief Medical Officer in a Government hospital.

Your doctor would do that.
