• Can I file revised ITR for FY 18-19

Sir/Mam

I was a contract employee (doctor) in a hospital in F.Y 2018-19 and I had filled ITR-1 form for that financial year, as I am contract employee I only got form 16-A from my employer, my gross salary was 655000 and TDS deducted was 65500 as I was not eligible for any deductions under 80c, I got income tax refund of 28100.

Recently my friend told me that I have filled a wrong ITR form ITR-1 instead of ITR-4 and my refund would have been more If I have filled correct ITR form because of 50% expenses can be shown ,
Now my questions is 
1. whether I have filled correct form or not? If not can I fill revised form again for F.Y 2018-19 now ?? Because I got less refund and I have read somewhere that ITR for f.y 2018-19 can be filled upto 30th June due to covid19.
2. As I am a doctor and done job on contract basis in hospital in F.Y 2019-20 , which ITR form I have to fill? And Can I show my income 50% under 44ADA

If they have issued you Form 16A then in that case they are not treating you as employees they are treating you as independent professional so yes if you have filed ITR 1 and shown salary income that's incorrect.

You must check your contract.

You can choose to file ITR 4 and show 50% as income if you are covered under the criteria.

You can revise it till 30.06.2020.

If you are a doctor you can shown your income under 44ADA.

Yes, you can take the benefit of presumptive taxation scheme u/s 44ada and show your income 50%.

 

Yes, you can revise the return till 30th June.

 

You need to file ITR 4 for the same.

1. You can file the revised ITR till 30.06.2020. You selected wrong ITR form for filing of ITR. The TDS is deducted under professional section and not salary. Ideally you should get defective return notice for selecting wrong ITR form.

 

2. Yes you should file ITR-4.

1. Yes, you have filed the wrong ITR form. It can be corrected by filing a revised return up to 30th June 2020.

2. You should file ITR-4 using Sec. 44ADA.

Dear Sir,

 

1. You have filed an incorrect return as you have received the Form 16A which means that you are working on contractual basis and providing professional services to the hospital and not working as employee of the hospital.

Yes, Income Tax return can be revised for the FY 2018-19,as the dates are extended up to 30th June 2020. 

 

2. You have to file ITR -4 and have to show minimum taxable income amounting to Rs. 3,27,500 (50% of the total income) under section 44ADA of the Income Tax Act 1961.

 

In case you will revise the return within the specified period (i.e up to 30th June 2020), then you are eligible for the refund of whole amount of TDS deducted.

Hi

 

Yes, you can revise your ITR and file another ITR form.

 

If you were an employee, you can't claim the benefits of section 44 ADA. 44ADA can be claimed only if you were receiving a professional fees as a doctor.
