• GST registration for MSME, Udyog Aadhaar

- I'm planning to start an online consultation and guidance program for students.
- There's no particular investment required.
- I'm planning to register this as a sole proprietorship MSME under Udyog Aadhaar.
- Expected annual turn over is around 2 lakhs.

Q1. There's no investment on plant, machinery or equipment. Can I still register for Udyog Aadhaar?

Q2. Udyog Aadhaar registration portal mentions that "Having PAN & GST number is mandatory from 01.04.2021." Does that mean I will need GST registration even the turn over is below 20 lakhs if I register for Udyog Aadhaar?

Q3. This is kind of a freelance job for me. If I'm using my friend's office for registration (with NOC and other documents), will I need to get the Municipal license ofher than Udyog Aadhaar registration?

Q4. I'll be using my personal bank account for the purpose. Will I need to file ITR even if my annual income is less than 2.5 lakhs?

Q5. "PAN & GST linked details on investment and turnover of enterprises will be taken automatically from Government data bases." In my case, if I'm not registered for GST and not filing ITR, will it affect my Udyog Registration any way?

Dear Sir,

1) Yes, you can get Udyog Aadhar without having any investment in Plant and Machinery. Meaning thereby any service provider who is not required to invest in Plant and Machinery can also get the Udhyog Aadhar Registration.

2)No. GST registration is not mandatory if the turnover is below the threshold limit specified under the GST Act.

3) No. Municipal licence is not required only NOC or rent agreement will be sufficeint.

4)Yes. ITR must be filed even if the income is less than Rs. 2.5 lacs to keep the status of Udhyog Aadhar as Active.

5) You will get the Udhyog Aadhar on self declaration basis but "An enterprises have to file income tax return and file GST return to maintain the status under MSME. Means a proprietary concern having income within exemption limit shall have to file ITR, if not wish to suspense MSME status."
