• GST on semi-finished flat

Hi

I have 2 agreements:
Agreement 1. Sale of semi finished flat by land owner (sale agreement executed in Jan-2018 And sale deed in Mar-2018)
Agreement 2. Development of semi finished flat by a developer (agreement executed in March-2018)

In both these agreements, I was charged a GST of 18%. I have following questions:
1. In agreement 1, am I liable to pay GST, as I have purchased flat from land owner?
2. In agreement 1, should the land owner pay me input credit which he may have received?
3. In agreement 2: Should the developer pay me input credit which he may have received?
4. In both these transactions I am unable to figure out if my GST reached Govt (though I have GSTIN numbers). Is there a way to find this information?

Hi,

 

Please note that you cannot claim any itc of gst paid to landowner or developer as you are nit engaged in the business of sale of flat.

 

I have assumed that the flat us used for personal purpose and not business purposes

1. Yes, you are liable to pay GST but you'll not be able to get the ITC for the same. It would be treated as your cost.

Yes, GST liability would be there.

ITC won't be available.
