Hi Sunny Sir, Hope you are doing well. I have a query, Could you please help me with an urgent basis? Query: I had registered a flat in Bangalore on Date 12th Dec 2019. Along with Flat cost, I paid 12% GST to builder which will be given to govt. On Jan-2020, I had applied PMAY. ( Note: while registration, I had no idea for GST rate of the PMAY candidate). On 31st Aug 2020, PMAY benefit came to my loan account. post that I wanted to take the GST benefit from Govt. I mean to say, I had paid 12% which should be reduced to 8%. The 4% GAP can be filed as Input tax credit (GST paid on purchases). When I told to builder, builder is not helping to get that 4% benefits. I think, builder will share the filed GST number. Could you please help me the process to get that amount from govt? Thanks in advance !!!

Hi Payal, Builder's CA telling, if PMAY would have come in between 6 months, we could have shown in input tax return. as it became 10 months which is not possible. If Builder will share the GST number, can i go ahead and show to GST commissioner of Bangalore and file the GST return? already paid and should I pay again for next discussion?
No, you can't do the same.
The builder can't amend the invoices or issue credit notes now. So, GST refund is not possible for the builder.
However, you may request the builder for partial refund from the builder's side to settle mutually to share additional GST costs.

Firstly, the project should be an eligible project under PMAY.
Refund is only possible through the builder and not from the government.
Ask the builder to issue credit notes for the same. The builder can issue credit notes till 30 sep 2020 in respect of invoices issued in FY 19-20.
