Dear Sir /madam Me and Wife as NRI holding Joint account NRE/NRO , Wife is house wife and myself on employment Visa overseas since past 8 years . Flat purchased in India on my wife Name and Payment made from NRE/NRO joint account . Since Past one year Flat is on rent and rental income (15000 per month <2.5 lacs per year) earned getting in same NRE/NRO joint account. We have not filed so far ITR any. My wife has received a sms from Income Tax dept , stating that Flat was purchased 48 lacs , Fill the ITR giving the Link e campaign >>> https://compliance.insight.govt.in Kindly advise if my wife need to file ITR ? if yes then Which ITR 1 OR 2.....ETC If No then what shall i do in this case ? No need to file ITR by wife even though the property is in your wife name. The property is entirely funded from your income and total rent is less than exemption limit. Please call for detailed discussion and assistance for online reply. I may assist you in online reply.
A tenant who pays rent to an NRI owner must remember to deduct TDS at 30%. The income can be received to an account in India or the NRI’s account in the country he is currently residing.
Hence you will be required to file ITR 1. If your tenant has not deducted TDS, he should deduct it and deposit with interest.

You would be required to submit your response on the E-compliance portal. It is not mandatory to file the ITR for your wife, but advisable to file. ITR-2 would be applicable.

Also, it is not mandatory to file ITR.
