• Will I get form 16 if I withdraw PF

Situation: I left a company "A" in FY2017-18 (October 2017) and move to another company "B" the same month. I did not transfer my PF from A to B. On March-8 2019, I left company B also and moved abroad. In the FY2019-20, I withdrew my PF from A and from B. Furthermore, I withdrew this PF before 5 years of service, which means a TDS should have been deducted and I can see the same in Form26AS. I have to file ITR for FY2019-20 this year. I have received a Form-16 from company B as I withdrew PF.

Question: Is company A liable to give me Form-16? Where can I find documented proof (rule book) for the same. Company A has already denied me of Form-16 in a very rude way. They are not even accepting the reasoning that company B has given me Form-16. Please suggest.

Hi,

In regards to your question Company A & B are not liable to issue you form 16 since you are not with these companies in the FY 19-20 and withdrawal of the PF doesn't entitle you to the issuance of Form 16 by the company.

Form 16 has no connection with whether you withdrew PF or not.

It needs to be provided by company if they have provided your details to income tax department.
