• Can we claim ITC for FY 19-20

We have two invoices one is Bank term Loan processing charges which is debited from our account in Jan 2020 but bank not provided invoice and the other is related to capital equipment( Partly received) and invoice generated for that part amount in March 2020 ,
For above 2 invoices we have not availed ITC, Requesting to guide me with the provisions for availmemt of itc after Sep 2020

- You can claim ITC of previous financial year i.e. 2019-20 till the due date of filing of GSTR-3B of sept. 2020 or filing of annual return whichever is earlier, irrespective of actual filing of GSTR-3B of sept.2020.

- If the GST returns of Jan.20 to March 20 is not filed yet then you can claim it.

The time limit for availing ITC for FY 2019-20 was only upto due date for the month of Sep 20. Hence, it cannot be claimed now.

The due date of filing of GSTR-3B for the month of September 2019 is 20th October 2020. Accordingly, a registered person can claim ITC for FY 2019-20 up to October 20, 2020.

 

Further, no debit notes and invoices pertaining to FY 2019-20 shall be accepted post-Sep 2020.

 

If you have already filed GSTR-3B then you can't claim the ITC for the same.

In terms of provisions of section 16(4) of the CGST Act, 2020, pending ITC related to FY 2019-20 can be claimed upto due date of GSTR-3B return for September 2020. Thus, practically speaking, the last date for claiming pending / hold ITC related to FY 2019-20 is 20th / 22nd / 24th October 2020, as the case may be.
