Hi, What should be there in "REMITTER NAME" field in 15CB and 15CA form. Should it be my Individual name or Proprietorship firm name .? While applying for new TAN I selected below in NSDL Individual/Hindu Undivided Family (Karta) [If a Sole Proprietor/HUF wants to obtain a single TAN in his/her name for all businesses run by him/her/it, then he/she/it should fill name in this field.] Thanks

Also - Can you please tell me the TDS rate for making foreign payment u/s 195 ? ( if I have TRC and getting benefits under ITAX rule ). Is it 10.4 % or increased . Thanks

The TDS rate in case of foreign payments will depend on couple of factors like nature of payment, its chargeability to tax in India, rates mentioned in DTAA vis-à-vis income tax act etc.
Without having those facts in place, it wont be possible to suggest any rate.
To your previous query, I would modify my advice and suggest putting in individual's name instead of proprietorship firm name.

While mentioning TDS rates we need to consider the nature of payment & provisions under Double Taxation Avoidance Agreement (DTAA) for the relevant country if any. In case payee fulfilling all the conditions as prescribed in the DTAA then rates as per DTAA will apply.
Generally rates under DTAA will be lower than normal TDS rates.

TDS rate u/s 195 will depend upon the nature of income. If its in the nature of royalty or FTS, then the rate will be 10.4%.
- Remitter Name should be of individual name. Propertiorship name is just a trade name for business purpose but PAN is allotted on individual name therefore Remitter name should be of Indivudual in case of sole propertieship.
- TDS rates u/s 195 depends on the nature of payment, DTAA provisions and availability of TRC. As you have mentioned TRC is available then benefit of lower rate can be given. Generally DTAAs are having lower rates than Income Tax rates. DTAAs rates are flat rates, there is no surcharge and cess applicable on such rates. 10.4% rate is under Income tax which is inclusive of cess@4% but when TRC is available you can avail lower rate of 10%.

Rate of tds depends upon nature of payment & on other factors therefore it is advisable to have a phone consultation for details discussion.
Individual name will be remitter name as PAN will be of individual.
If you are issuing 15CB on TAN it can be a different story.
