Not required to file again in F.Y. 2024-25 if you opt for old regime. Portal will not allow you to file it again for F.Y. 2024-25. If accidentally you have withdrawn from it then you can now only opt new regime unless income from business or profession ceases

For F.Y. 2024-25 you might have filed Form 10IEA for withdrawal from old tax regime. Check filed Form 10IEA for F.Y. 2024-25. To opt for old tax regime, Form 10IEA is filed only once and subsequently it is filed for withdrawal from the old tax regime

As you had already opted for the old tax regime in FY 2023–24 by filing Form 10-IEA, you do not need to file it again for FY 2024–25.

However, since you have accidentally filed it again, this second filing may be treated as a withdrawal from the old regimeonly if you have business or professional income.

  • If you do not have business income, no issue — you can still choose the old regime while filing your ITR.

  • If you do have business income, you may now be locked into the new regime, and reversal is generally not allowed.

As your return is not yet filed, you may try raising a grievance on the e-filing portal or contact your Assessing Officer to explain the accidental filing.

What is the nature of income that you are earning?
Are you earning business income?

As per my understanding you cannot file Form 10IEA twice unless you have selected separate option. So first we need to check what you have mentioned while filing Form 10IEA.

If you have income other than business income, filing 10IEA is not relevant.

Yes. You can continue to file under the old regime this year (AY 2025–26) because:

  • Form 10‑IEA is valid for only one financial year—so even if you filed it last year and again this year, it does not cause any conflict.

  • Filing the form again (even accidentally) means you're locked into the old regime for this AY.

  • You have not yet submitted your ITR — this gives you full control to now file it correctly under the old regime.
