Please let us know whether the business is being carried out in as a proprietorship firm or a partnership firm.

If its in the structure of proprietorship firm, you can take the registration without his approval.

Yes you can get register with majority of the owner approval. No need to for all the owner sign and signatures. however prof need to be submitted.

Alternatively you can also pass a deed to remove him from property and than can go for GST migration

I suggest that you may constitute a partnership firm with all consenting partners. Then apply for GST in the name of the firm. You can then independently settle your issues with your dissenting legal heir.
