Sir,
You have to request for 143 (1). See if you have any TDS . And they have not taken claim for that.
I see an outstanding tax demand for the AY 2004-2005 in my account. As far as I remember I have paid all the taxes. I was unable to download the 26AS to check my tax credit. Since its 13 years old I do not have any documents pertaining to the same. How do I check if such demand was raised and if I have already paid or otherwise for what this demand was raised ?
Sir,
You have to request for 143 (1). See if you have any TDS . And they have not taken claim for that.
In the compliance section, you disagree with the outstanding tax demand and ask for the intimation u/s 143(1) and then compare with your claims in the return by downloading the return from the portal, if it was efiled. You may also check to see who is having the rectification rights, CPC or the jurisdictional AO. You may then file an application to the concerned authority for rectification by furnishing whatever details you have.
Rectification rights is with the AO. Returns are not available in the portal and the auditor who filed this return is no more and I do not have any documents since its about 13 years old. On what grounds can I disagree with the outstanding tax demand ? Should I write a letter to ITO who I assume is the AO to provide me the intimation u/s 143(1) ?
Rs.26456
Then you should approach to AO and get the intimation.
Do you have such amount of TDS which can add up to this amount
As the rectification rights are with the ITO, you can write a letter to him describing your case with the details of nature of your income and the constraints in getting the details. You can then submit them in the Inward or send it by post. If possible, you may meet the concerned ITO and sort out the issues. Generally, the IT Dept is user friendly particularly for common people.
If you don't get a result even after 3 months, you may represent your case before the Commissioner, having jurisdiction over the ITO.
If you still don't get proper response, you can also approach Income Tax Ombudsman.
Sir you need to approach the IT Officer with a written letter asking him to provide an intimation U/s. 143(1) of the IT Act,1961 . If you receive the same then you will be knowing how the Tax demand is being calculated.
You need to compare the intimation with your Income tax Returns filed and make out the difference. If you are not satisfied with the intimation then you need to write for the rectification thereof.
