• Indian Resident earning dividend income from USA Corporation

Hello,

I m Indian resident, I'm earning dividend income from company ( C-Corporation )  in USA. There are some tax been already deducted at source ( USA )
Should I be paying tax again in India ?

As per our view no need to Pay tax on the Tax already paid in USA as there is a DTAA with USA

Dear Sir,

As per article 10 of India US DTAA, dividend paid by US company to you will be taxble in India. However, you can avail to tax credit of TDS already declducted in US.

Yes you need to pay tax on dividend income earned in USA as you are a Resident. You can, however, claim the credit for taxes paid in USA under Double Taxation Relief Treaty between India and USA.

Hello,

Tax is very well required to be paid in India. But as you said that withholding tax is already deducted in USA. You can claim the credit for the amount of tax paid in USA and any difference if payable shall be paid by you.

Hello,

You can take the benefit of the DTAA agreement and adjust the already paid taxes in USA against the tax payable in India. Balance if any shall be paid by you.
