• Regarding HRA

Hi,

For 2016-17 HRA, my landlord has not provided pan details and unlike every year i can not provide no pan declaration.As a result I had to submit HRA for 8333. Now I got his PAN details.  Can I get the returns by providing his pan card no. and agreement while filing .Also I do not have any bank transactions for the same.Any suggestion would be appreciated.

HRA exemption you can claim as given in your FORM 16, if you are claiming excess amount then you may receive Notice from Income Tax Department , thus avoid to do this practice and update landloard's pan with enhanced rent amount with your employer so that your current year TDS deduction reduce accordingly.

Hi Swathi,

We need to check your salary slip in order to see that how much amount of HRA you have recieved from your employer. Because while filing your return of income you cannot claim exemption of HRA more than what you have got from your employer.

Hello Swathi,

Yes you can get the money refunded while filing the Income Tax Returns. But be prepared that your return may be subject to scrutiny, so keep the rent agreement and rent payment receipts handy since you do not have bank payment record of the same.

Hi Swathi,

Yes, you can claim higher HRA in your return. However, please ensure that you have an appropriate rent agreement and rent receipts so that in case your case gets picked up for assessment, you can prove the HRA.

From this year onwards, if your rent exceeds 50K, you will have to deduct tax.
