• Income tax notice

My dad expired on Jan 16 due to illness , got a notice from income tax dept recently as my dad didn't claim income tax returns from past 1 year. Now what should we do ? And one more my mom will be getting gratuity and pf around 20L and we deposited Back to company to get basic DA till my dads retirement. So my mom will be getting basic DA around 50k per month till retirement so should my mom also pay income tax ?

Yes your mother should file the return as well. Moreover, you have to reply to department of notice and file the return on his behalf as legal representative.

You should file income tax return of your dad adding income till his death. Yes, your mom should also file income tax return. Regarding the taxability of the amount, i ll get back to you.

You need to respond to the IT notice about the death of your father. If your father had gross total income exceeding the basic slab applicable to him, the legal representative has to file the return. However, you need to register as a legal heir in the efiling portal. If you do not know his income details, you may mention the same to the ITO while responding to the notice and request him to furnish the details of your father's income as per IT records.

Your mother needs to file return for the pension she gets and the interest on the deposits.

Check in your income tax site that window is still active to repsonse the notice or not. If its still active you can reply online. If not you can file the return and then sublit the repsonse to IT Department physicallt to IT Offcer.

1Yes if the same is taxable then on behalf of dad your mother should pay.
