• Audit under - EA - 2000 reg

Hi , I received a letter  from ServiceTAX / GST department  about conducting  Audit in my Unit next month . The letter sample below.

I only registered under Service Tax law  as a Service provider ( I am not a manufacturer  or Good import exporter )..I have no registration in Central excise. I only export Service.

But the below letter looks like only for those who have Registered in Central  excise

Have they mistakenly sent me letter? Please clarify.What should I do now.

Sub: Intimation for Conduction Audit  UNDER - EA - 2000  Reg
.
Please send following doc to head office.....
.3> Yearly Duty payment picture through PLA 
 4> Details Flowchart of Manufacturing process 
 5> Copies of ER-1

...............
( The letter being issues as per transition provision of section  174 (2)(e)    of CGST Act  2017  read with Rule   5A [2]   of the Service Tax rule , 1994  section 94 (2)(k)  of Finanace Act )

Hi,

You can respond to the notice mentioning the fact that you are not a manufacturer and hence these details are not applicable to you.

Please feel free to call/ revert in case you need more clarity.

Have you filed Transitional forms under GST? It may be because of some wrong information provided in those forms.

You may reply to the notice stating that you are only a service provider and not registered under excise as manufacturer, etc.

Its not that such audits can be done in respect of excise only. It can be enforced for Service tax also. But, the point is, the details you have been asked to submit is in relation to excise, which you are not liable to.

In case of service tax, officers can collect evidences from your premises. But they can't do an audit but only refer a direction for an audit to be done by a Chartered Accountant.

On a personal note I dont feel any business man is in a position to talk to an officer as they will make up their own laws in order to scare you. In my opinion it is best to hire a professional in your own city who will attend the officer on your behalf on his visit.
