i have an ecommerce business and i am having an contract with supplier of services to provide his service when customer pays from your website, so i don't purchase and sell i m just an intermediary.
so i have some sales agent (name: a) who bring such creditors to me and other sales agent who bring customers to my website, these sales agent (name :b) are not my employees , we have an agreement for commission. I am not doing interstate till date.
so my question was : some a and b sales agent are small and  some i pay more than 30k in a year so do i need to deduct any gst  and do i need to deduct even tds?
do i need to deduct tds for my creditors while paying them money which i received from customers and how much under which section
do i need to deduct gst and tcs for my creditors , please help me? any other complaince which i forgot

Hi

If your commission agents are not registered under GST, you shall be liable to pay GST on reverse charge basis.

Further, if amount of annual commission to an agent exceeds Rs.15000, TDS @5% shall have to be deducted.

you have to take 2 registration under GST 1 as Ecommerce operator and other as normal taxable person, in transactions with agents if they are registered then they charge gst on his services other wise no gst , TDS under income tax is liable if amount exceeds Rs. 15000 and rate of TDS is 5% under section 194H

while paying to creditors you have to collect tcs under gst and on your commission part (which you deduct while payment made to creditors) creditors have to deduct your tds

Hi,

you have to take registration under GST as Ecommerce operator and as normal taxable person.

If your agents are registered under GST then they will charge gst on their services otherwise you have to charge it on reverse charge.

Further, there are also provision relating to collection of tcs under gst which are currently deferred.

TDS is applicable @5% if commission amount exceeds Rs. 15000.
