I have worked in my family business own by my brother for 17 years and in 2011 I have separated with him and established my own business.

as per understanding he give me 15 lacs as good will of 17 years

My question is that whether I have to pay Income tax for whole 15 lacs which is my 17 years remuneration as i did not get even single rupee in that 17 years

If your family business is a partnership concern with you as a partner, the retirement funds received are not subject to tax and not in the nature of goodwill also, as held recently by the Income Tax Appellate Tribunal, Hyderabad in a recent case following the decision of the Supreme Court in the case of CIT V/s. R. Lingamallu Rajkumar.

If you are not a partner in the partnership concern or the family business is a proprietary concern, then it amounts payment of gratuity if you are an employee and the exemption available for gratuity can be claimed. However if you are receiving this amount without any formal association, the nature of association needs to be established for assessing the tax liability.

yes goodwill is capital asset and cost of the same is nil thus you have to pay tax on the same but first check brothers accounts (if possible) might be he is showing you salaried and accumulate you salary over the years and shown as one shot payment , other wise if he is agree show this amount as gift then no need of payment of any tax

If you have a blood relation with him then the entire transaction is tax free.
