• Tax Liability Till Date

Hi Vishaka,
Greetings!!

I worked with many companies for short duration and some employment breaks were there. Everywhere I worked , my tax got deducted from salary. And I never bothered to file ITR as the companies were doing the same, I believed. But now I am concerned about the same as I want to know whether the return has been filed by them on behalf of me or not and if not then how can I get the details of who has filed the return and who not. And I also want to know total tax liability till date.

What is the process of knowing year to year tax liability.  Is there any process of knowing it myself , without asking the employer about FORM 16.

Hii...

in employment Employer deduct your tax only as TDS on Salary income , they did not file ITR on behalf of you, its your duty to file ITR and disclose all your income along with salary if any.

if you worked under different employers in the same year (between 01 April to 31 March) and not sharing income details from earlier employer with current employer then current employer deduct TDS from your salary assuming you have no earn any income in this year.

for example

if you worked from April to September under Mr. A and got Salary of Rs. 300000 (Yearly 600000)

if you worked from October to March under Mr. B and got Salary of Rs. 400000 (Yearly 800000)

in above case

Mr. A deduct TDS assuming your Estimated income is Rs. 600000(Yearly) and Deduct TDS Monthly upto September

Mr. B deduct TDS assuming your Estimated income is Rs. 400000(Yearly) and Deduct TDS Monthly from October to March)

but your total income in above case is Rs. 700000 and Tax on this amount is much higher due to change of Tax rates slabs

thus you have to pay tax on your total Taxable income earn during the year from all sources

Hi,

Employer's liabiity is to deduct Tax from your Salaries, pay the same to the Govt and File TDS Returns to give proper Tax Credits to the employees from whose salary Tax is Deducted at Source. It is your responsibility to file IT Returns every year.

You can login to Income Tax Website portal using your PAN and check which Year IT Returns were filed. If no Returns have been filed till date, you can file the same now for 2 Years (i.e FY 2014-15 & 2015-16)

To calculate your Tax liability, you will require the Form 16 issued by the Employer or your Income Tax Working Sheet provided by the Employer

Dear Sir,

Tax liability can be determined from form 16. However if same is not available you can file your return for last 2 years with the help of salary slip, investment details etc facts.

It is unlikely that your employer had filed your return.

You can check your form 26AS and then determine tax liability and files your return.

Hello Sir/ Madam,

There is no scope that any of your employers would have filed your Income Tax Returns. They would have mere deducted the TDS from your salary and deposited the same with the Income Tax Department post which your Form 16 would have been generated.

You can check the liability only if you have the Form 16 or the pay slips. Either or is required.

Greetings!

1) To check whether IT returns has been filed on your behalf by the companies where ever you had worked, you need to login in to income tax site.

https://incometaxindiaefiling.gov.in/e-Filing/UserLogin/LoginHome.html

if you dont have login id you need to create one by registering yourself on the above site.

For Login you need to have your PAN card number, your Date of Birth and a password.

Once you have Login ID -you can login- after login you will be taken to Dashboard- where you can check all returns filed by you, whether return has been processed or not.

For any demand due from your end-

On Dashboard- there is also one Tab of My pending action which will show if any demand is due or any other action is pending.

To check how much TDS has been deducted on your behalf – you can go to quick link- click on view Form 26AS –

26AS reflect whatever TDS has been deducted and paid on your behalf. TDS is being deducted by employer; bank on Term Deposit, etc.

If returns has not been filed , still you have time to file the return for FY2015-16 upto 31st March 2017.

Tax liabilty you can calculate by checking 26AS, (in case Form 16 and / or salary slips are not available)

26AS will show how much salary is paid by your employer and how much tax deducted on that salary.

you need to add other incomes and then calculate Tax liability.
