• Haven't paid income tax for period 2011-2016

Graduated in June'11
First job in July'11 : annual package 3.16 lakh INR, no other source of income
Didn't file income Tax Return , because i assumed it was not mandatory to file income return if your annual income is less than 5 lakh.

2012-13
Annual package : 3.5 lakh, no other source of income
Didn't file income Tax Return , because i assumed it was not mandatory to file income return if your annual income is less than 5 lakh.

2013-2016
left job in July'13 and started preparing for Government Examinations.
No source of income (except 5000-10000/month in tuitions)
No income, thus didn't file income tax return

I haven't filed even one income tax return since 2011.
Kindly advise:
1) Are my assumptions correct that I didn't need to file income tax returns in these years?
2) If yes, is there some way that i can get some sort of "ALL_Clear/ No objection" certificate from income tax department?

1. Sir in all the years we need to check for the Form 16 as the taxable income will be calculated only after all exemptions like HRA, conveyance etc and also after all deductions i.e. LIC, mediclaim etc. If that is above taxable limit then you need to file. But since the time has elapsed you cannot file the returns for past years unless you get a Notice U/s. 148 (Income escaping assessment).

If as per our assumption if the income is not taxable then you need not file the Returns.

Good Morning

If when you are in employment proper TDS deducted then your assumption is right

Department not issuing ni objection or all dues clear certificates coz first we submit our itr via self assessment after that department process our return and provide 143(1) intimation

You can file your itr if AY 2015-16 & AY 2016-17 now to avoid any income tax notice for non filling of itr

Hi,

For FY 2011-12 to FY 2013-14, you will have to check the Form 16 for Tax Liability and whether your employer has made proper TDS.

If there is no tax payable, you need not worry.

If there is Tax refundable, you can go for Condonation of Delay u/s 119(2)(b) if you wish.

If there is Tax Payable, then you may be in trouble. But given your Income, the liability may not be substantial.

For FY 2014-15 and 2015-16, you can still file your Income Tax Returns

Hi,

Looks like Proper TDS was deducted in AY 2012-13 and 2013-14.

Since you didn't have any Income on AY 2015-16 and AY 2016-17, there is no question of Filing IT Returns

For AY 12-13 , There is no Tax , thus no need to file.

For Ay 2013-14, There is tax. If you have not claimed all your deductions then you can claim. If after that adjustment the income is below tax then no need to file.

If there is no income then there is no need to file tax returns

As per the details provided by you, it appears that your employer has deducted the rightful taxes and paid it to the government. So you need not worry about the same.

It is advisable to keep filing your returns regularly in order to avoid compliance notices.

Dear Sir,

First of all lete tell you there is no certificate from income tax department in the nature of no objection or all clear.

Secondly, to conclude whether you were required to file ITR in FY 2011-12 and 2012-13 or not will depend on your total income during that year. For that we need your form 16. Please share the same.

Your presumption that no ITR is required to be filed below 5 lacs income is alps not correct.
