• Although I am a paid employee - I haven't submitted return or paid

I am a 53 aged Co op employee and earnig Rs.700000 per year.But I haven't sumbit tax return as yet.Now I wish to sumbit return.and also wish to remit tax monthly from my salary as TDS.Can I do it ?

You can file AY 2015-16 & AY 2016-17 ITR's by 31st March 2017

Monthly TDS deduction is responsibility of your Employer

However if Employer not deduct TDS than u can pay such tax as Advance Tax to avoid interest on late payment of tax

Your employee is responsible to deduct tax at source from your salary by computing your tax liability based upon declarations made by you in respect of income from other sources and investments/payments made by you for claiming deductions under Chapter VIA of the Income Tax Act. As a responsible employer, mostly likely your co-operative society would have done it. If it is so, the tax paid by you by way of TDS would have been more or less equal to the Tax liability. Unless you have other sources of income for which additional tax liability is there or you want to claim certain deductions, which were not declared to your employer, there is no tax impact even if you did not file your IT Returns.

Most likely you would have received notices for non - compliances, which can be seen if you login into efiling portal of the Income Tax Department. You need to submit answers to them appropriately.

Now you have to file your IT returns for the financial years 2014-15 and 2015-16 latest by 31st March 2017, as filing of IT Returns is mandatory when you have taxable income. You cannot file returns for earlier years as they are time barred.

Hi,

It is the duty and responsibility of the Employer to Deduct Tax from your Salaries at the rates in force for that particular year. It is your responsibility to File Income Tax Return every year if your income exceeds the basic exemption limit for Income Tax.

In your case, you may very well be liable for Income Tax subject to various exemptions and deductions. If you didn't have any income other than salary, the co-operative society being the employer should have deducted proper Tax for every year.

Dear Sir,

Whether any TDS is deducted from your income till date. If yes than even though you have not file your return it is not mandatory till your income reached to 10,00,000/-. subject to you do not have any other income thna interest income.

Also if you want to file return you can do the same now for the year 2015 - 16 along with payment of tax if any required to be paid.

You can submit ITR from FY 2014-15 onwards, and in future you have to inform employer to deduct TDS on salary monthly basis.

Due date of filing ITR is 31st July of every year.
