• How to Cliam belated TDS Return for FInancial Year 2013-14

My sister working as lic agent and earned 3,58,230 and the tds amount is 35,000 rupees deducted for  financial year 2013-14.. now she want to claim the refund.but the due date for this reurtn is over .so kindly suggest how to claim such refund said above.i heared that section 119 of the income-tax act, 1961 - income-tax authorities -instructions to subordinate 
authorities - condonation of delay 
in filing refund claim and claim 
of carry forward losses under 
section 119(2)(b)
circular 9/2015 [f.no.312/22/2015
-ot], dated 9-6-2015.
Let me know how to apply for condonation of 

delay in filing returns claiming 

refund and returns carry forward 

of loss .Is there any need to submit receipts while processing my Request.She don't have specific receipts with me.Please Kindly suggest me How to Claim that huge amount.Thank You Sir.

Hi,

You can apply for Condonation of delay u/s 119 (2) (b) and claim the Refund.

The application has to be presented to your Jurisdictional Commissioner of Income Tax (CIT). Request you to approach a local CA in this regard as this will require representation before the CIT to get the permission for filing belated returns.

Once the permission is granted by the CIT, then the Return can be filed online using the Option "Condonation of delay u/s 119(2)(b)" while preparing the Return

You need to approach the Commissioner of income tax for condonation with a valid reason for non filing. After acceptancean approval letter will be sent to you by department. Based on the same you can file returns.

You can file for refund but carry forward of losses cannot be done.

You need to make an application to the Principal Commissioner u/s 119(2)(b) in accordance with the Circular referred to by you. You may submit 26AS to evidence the deduction of tax along with your application.

You can apply for Condonation of delay u/s 119 (2) with a robust and strong reason and claim your Refund.

You have to present the application to your Jurisdictional Commissioner of Income Tax (CIT). You have to approach a local CA in this regard as he need represent your case before the CIT.

After getting the permission return can be filed online.

Hello Sir,

h of delay is a very long process. Plus it is almost impossible on a personal level, you may have to hire an expert for the same and the fees will be almost at par with your TDS.

So it is advisable to wait till you receive a notice for non-filing, you can easily file a return against that notice.
