• Regarding 142(1) notice

Hi,

My tax returns for the Assessment Years 2015-16 and 2016-17 were filed and processed. I even got my 143(1) intimation from CPC a long time back. Everything looked fine.

But, 4 days back I received 142(1) notice for these two assessment years (2015-16 and 2016-17). It's mentioned in the notice to file correct taxes or to produce the copies of my tax returns and financial statements, if my tax returns are already filed. I got this notice from my Jurisdiction Income Tax Officer.
If my 143(1) is already received, doesn't that mean my taxes are already assessed and processed? I'm wondering why the 142(1) has been sent now?

I would really appreciate any help on this matter.

Dear Sir,

143(1) is only preliminary assessment. A detailed scrutiny can be undertaken even after 143(1) has been cleared.

Further 142(1) is not scrutiny notice. You can reply to the notice and submit the required documents.

Hi,

Intimation u/s 143(1) is not a final order. Department can issue notice u/s 142(1) and/or 143(2) and scrutinize your Returns of income subject to the timelines prescribed under the act.

Sir you can receive 142(1) after intimation U/s. 143(1).

This notice is calling for information . If the department wants certain information regarding any info. then they can send you this notice

1) Pl check the dates of your filing of IT Returns and the date of notice. It is possible that you would not have filed the returns at the time of issue of notice. Most likely this may not be the reason.

2) The assessment is done on summary basis, by accepting the return as filed and making adjustments only for arithmetical and apparent errors in the return. This is called as summary assessment u/s 143(1) and you will be issued intimation, which is more like assessment order.

3) Some cases will be selected for scrutiny to be done by your jurisdictional ITO, by calling for such information and documents as may be required to determine claims. This is called scrutiny assessment u/s 143(3). It is most likely that your case is selected for scrutiny. The basis for scrutiny is given by the CBDT and based upon such parameters, your case might have been selected for scrutiny on what is called as CASS(Computer Aided Scrutiny Selection).

In any case, you need to respond to the notice preferably with the help of a professional. However, there is nothing to worry, unless you have not disclosed your income properly.

Hello Sir,

143(1) is just an intimation which only checks the arithmetical accuracy of the data provided by us in the return whereas 142(1) is when they ask for actual physical records to verify if the details filed are correct or not.

So long story short the assessing officer has the power to send you a notice u/s 142(1).

Hi,

CPC through its 143(1) notice only verifies arithmetical accuracy of the return filed. However, a 142(1) notice is a notice for scrutiny assessment, wherein your assessing officer wants to verify your books of accounts. A 142(1) notice can be sent irrespective of whether a 143(1) notice is sent to you or not.
