• IT return for FY 2009-10

My bankers wrote to me on 16 Jan stating they have received a query from the IT deptt regarding my IT details of FY 2009-10. The bank has asked me to send them a scanned copy of ITR for FY 09-10. Having read on the net earlier that IT returns of last 6 years should be held, I have destroyed the previous years IT Returns. 
What do I do now? I don't also know what is the query asked from my bank!

First, ask them to show you notice of IT Dept. and confirm if it relates to you. Secondly, you can get the same through your income rax site, provided you have filled online.

Hi,

If the income escaped is Rs. one lac or more the notice u/s 148 can be issued within 6 years from the end of relevant assessment year. Practically, it means that you are liable to maintain your returns and related documents for 8 years.

If the return was filed online, you can download the copy from income tax site.

Further, you are not obligated to give returns to your bank, if you dont want to. If you have not received any notice from IT department, then no need to worry at this stage.

Hi

The assessment for FY 09-10 is within the time limit prescribed. However, please only reply if the notice is received by the income tax department. You are not bound to reply to the bank regarding income tax issues. The bank would not receive any such enquiry.

If you have e filed, you will be able to download them after logging in to the efiling portal of the Income Tax Department.

Your Bank need not be concerned with your IT Return, if they have to address the query received from the IT Department. They need to provide such information only from the bank statements. You may ask your bank to show the notice/enquiry received from the IT Department and find out what exactly is the nature of the IT Enquiry. If the bank still insists upon the iT Return, you may take the help of a CA.

Hi,

First visit your Bank Branch and confirm whether they actually sent the Letter or email to you. This may be a fraud.

IT Dept will never write to Bank to produce your IT Returns. They can, at the most, ask for your Bank Statements

Hi,

Please visit the bank and obtain their request for your tax return in writing. They are duty bound to ask for it in writing and also provide a copy of the notice received by them.

If you had filed your return online, then you can obtain a copy of it from the website of the Income-tax Department.

You can inform the bank that the copy of the returns are not traceable at this point or you can visit your Income Tax Officer and ask them to provide you a copy of the same or approach your CA if he has maintained a copy of the returns.
