• Demand Notice for not filing income tax return for year 08-09

Hi,

I had uploaded my return for assessment year 2008-09 but it seems I forgot to post the signed acknowledgement to CPC.

Now I see I have a demand of 19000 INR pending against my name.

How can I file this return? I tried online but was unable to do so. Is there anyway I can file the return and get an exemption from paying this amount?

Hello.

Based on the info provided by you, I assume that you had filed the respective returns but forgot posting the acknowledgement.

I don't think that should be the reason for the demand. You need to check your intimation u/s 143(1) to check the actual discrepancy if any.

In case you dont have the intimation copy then you can re apply for it on the IT efiling website.

After going through the same a further course of action can be advised.

Hi Deba,

For which year is the demand of Rs 19000 is being shown as outstanding ?

Coz without filing your return of income there can be no demand also outstanding.

Secondly we cannot file return for Year 2008-09 now as the time for filing returns for 2008-09 has crossed its time barring limit.

There is an option online on the income tax website to check for which year the demand is being shown as outstanding and if it is not correct and we do not agree with the same we can post a response accordingly.

After logging in your income tax account there is an option WOrklist. In that option go for For Your Action. In that section the details and working regarding the outstanding demand would be given.

You can write to us about further details as to how to proceed with the same.

Hi,

Deba you have taken the right course of action by disagreeing . Hope you have provided your reasons for the same. And as your return was not filed online and A Y 2008-09 being a year before online returns started you will not be able to generate 143 (1) online.

Lets wait for sometime for them to revert to our disagreement. Further if it doesn't get resolved we shall have to approach and write to the jurisdictional Assessing Officer.

you have to make sure that the challan serial number and deposit date have been correctly entered while filing your return, else the credit of taxes wont be given.

Hi,

If you have not received intimation u/s 143(1) you can visit Income Tax E-Filing Website and request for re-sending of Intimation u/s 143(1) / u/s 154

If demand is shown to be uploaded by AO in the above table, rectification right is with Assessing Officer, you have to contact your jurisdictional Assessing Officer for rectification.

For the demand against which there is “No Submit response option” available such demand is already confirmed by the Assessing Officer. You have to contact your Jurisdictional Assessing officer for rectification if needed.

If you have any concern on return processing by CPC, you can submit your grievances online. For details you can check our other article Tax Payer can submit online grievance relating to CPC and efiling of Income tax Return

You or your representative can visit ITO and contact your Assessing Officer, with all the documents to prove your income and deductions claim for AY 2008-09.

Sir you can approach your concerned income tax officer and get intimation u/s 143(1) which is assessment order which states your return is processed. In that you can know where is the difference between your data filed and department calculation. Then you can give the answer based on which the demand is raised

Hello,

You may not be in a position to receive an Intimation online since a Manual return was filed. You have to personally approach the ITO for the same.
